Appellate Practice

Appellate practice is not just another phase of litigation; it is a specialty.  It requires knowledge of how the appellate rules work and how the appellate courts decide cases.  It requires appellate brief-writing skills and familiarity with oral argument before appellate courts.  It requires the ability to advise clients whether to appeal and if so, how to do so:  not just factual and legal analysis, but judgment as to which arguments to advance, which to forget about, and how to present your appeal in the most positive light possible.

Kraemer Burns attorneys have had major appellate experience.  Dozens of appeals have been briefed and argued in the New Jersey Supreme Court and Appellate Division, as well as the United States Court of Appeals for the Third Circuit.  Three Kraemer Burns attorneys have clerked for the New Jersey Supreme Court and one has clerked for the Appellate Division.  Two co-chaired the New Jersey State Bar Association's Appellate Practices Study Committee.

We are prepared to help clients and attorneys with any stage of appellate work -- from initial advice to final argument.
